Beta Terms

Terms for the closed, free and provisional Roost2D Studio Beta.

1. Provider and scope

The provider is Sebastian Barez Software Development, proprietor: Sebastian Barez, at the address stated in the Legal Notice. These Terms apply only to the invite-based, free Roost2D Studio Beta. Paid subscriptions, commercial Release plans and other paid services are not part of the Beta.

2. Participation

You must be at least 18 years old, have a valid personal invitation and protect access to your account. Invitations and accounts are not transferable.

Access may be subject to usage, capacity, model, storage and generation limits. The Beta may be changed, restricted, suspended or discontinued for development, security, legal or capacity reasons. Where reasonably possible, material changes or discontinuation will be communicated in advance. Mandatory statutory rights remain unaffected.

3. Studio and AI-generated results

Roost2D Studio uses automated systems, including AI systems, to create proposed source-code, asset and project changes from your instructions.

Studio attempts to verify candidates through automated checks such as type checking, tests, builds and browser verification before promoting them to the project's current version. These checks do not guarantee that generated code, assets or games are error-free, secure, suitable for a particular purpose or legally usable.

You remain responsible for review before publishing, distributing or otherwise using a project, including third-party rights, licences and suitability for your intended use.

4. Your content, generated output and licences

You retain any rights you have in submitted content. You grant the provider a non-exclusive right to process, reproduce, modify, store and technically transmit it only as reasonably necessary to provide, verify, secure, maintain and improve the requested Studio service under the Privacy Notice. Submit only content you are entitled to use for these purposes.

The provider does not claim ownership of project-specific AI-generated output merely because it was generated through Studio. To the extent the provider obtains transferable rights in that output, those rights are granted to you for your use of it.

Rights in Roost2D, Studio, templates, reusable engine components, third-party software, models, fonts and assets remain subject to their applicable licences.

5. Acceptable use

You may not use Studio for unlawful activity, malware, attempts to bypass security or usage boundaries, unauthorised access, child sexual exploitation material, targeted harassment, fraud, materially deceptive activity, unlawful gambling, or unlawful financial products or services. The version of the Acceptable Use Policy identified in the acceptance dialog forms part of these Terms.

6. Beta availability and changes

The Beta is experimental and is provided without a contractual service-level or uptime guarantee. Features, supported models, usage limits and technical behaviour may change. Requirements and remedies that cannot legally be excluded, including mandatory digital-product rights where applicable, remain unaffected.

7. Liability

Liability under mandatory law remains unaffected, in particular for intent and gross negligence, injury to life, body or health, and under the German Product Liability Act. Otherwise German statutory law applies. Mandatory consumer rights are not limited.

8. Termination and project content

You may stop using the Beta and request account deletion at any time. We may suspend or terminate access where reasonably necessary because of abuse, security risks, legal requirements, serious breaches or discontinuation of the Beta. Where applicable, statutory rights concerning access to content created or provided by you after termination remain unaffected.

9. Privacy

The Privacy Notice explains processing of personal data, AI and hosting providers, retention, international transfers and your data-protection rights.

10. Governing law and disputes

German law applies. If you are a consumer, this choice does not deprive you of mandatory protections under the law of your habitual residence. The provider is neither willing nor obliged to participate in consumer arbitration, unless participation is required by law.
